Scheduled Waste Management

The Environmental Quality Act, 1974 placed strict restriction and imposed heavy penalty on any form of pollution on atmosphere, soil and inland waters as stipulated in Section 22, 24 and 25 of the Act. Section 25 particularly places restriction on discharge or deposit of any environmental hazardous substances, pollutants or wastes and result in pollution on inland waters. Any person who contravenes these sections shall be guilty of an offence and shall be liable to a fine of not exceeding one hundred thousand ringgit or to imprisonment for a period not exceeding five years or to both.

In view on the serious penalty imposed on the offenders, and to encourage proper industrial waste management, Malaysia government has developed a comprehensive set of legal provisions related to the management of toxic and hazardous wastes. The Environmental Quality (Scheduled Wastes) Regulations 1989 came into force on the 1st May 1989 with the intention of regulating 107 categories of wastes classified as scheduled wastes listed in the First Schedule. The regulation was based on cradle to grave principle whereby the scheduled wastes was properly managed from its generation to its ultimate disposal at an approved treatment facility.

To ensure that the generation of schedule wastes from the construction and operational activities is properly managed in accordance with the Environmental Quality (Scheduled Wastes) Regulations 1989, the setting up of a schedule waste management system and to identify a proper storage area to ensure safe storage of scheduled wastes on site is essential.
